can he stop me moving
I have 2 children who reside with me in QLD, my ex lives in Darwin and is in the army. He is putting in a new proposal for new orders in regards to seeing the children. In the new proposal he is trying to obtain a shared care arrangements for when he returns to Brisbane which may not be for 2 years, in doing so he is trying to stop me from moving from the area i live in. Is he able to stop me from moving from this area?

Your ex can make an application to court to try to stop you from moving. However given he is living in Darwin he might have difficulty in succeeding. The court must decide what is in the best interests of the children. The outcome would depend upon a number of matters including where you propose to move, the number and ages of the children and the nature of the relationship each of them have with each of their parents. I suggest you seek the advice of a lawyer specialising in family law as soon as possible.
