Legal Question in Employment Law in Australia

Contract Letter Terms and Conditions

Hi

I am working in IT Industry. I am employee of XXX company and working at XXX client site. Now I would like to work for same client but with different employer.

In my contract letter given by my current employer, one condition is mentioned

''For a period of 12 months from the date of termination of employment, you will not divert or attempt to divert from the company's customer during the 12 months prior to termination of your employment''

Does it mean I can not work through different employer with same client

I have asked for legal advise and they have said I do not have any restriction and I can work

Please advice

Thanks for your time.

Re: Contract Letter Terms and Conditions

the clause you have quoted does not make any sense.

if you have quoted it accurately then the advice you have been given may be correct.

it would be unsafe for me to express a concluded view without seeing the whole of your contract.
