Legal Question in Real Estate Law in Australia

leaving a house in the will for a child

I am coming into a large amount of money, in which I will purchase a house (nearly outright), when I pass away is it possible to have the house passed onto my son, not to my husbands children. He has 5 children to another women. As my husband says he agrees with this, is it possible to get it in a written contract, so it is all legal? What if the house is in both our names?

Transfer the property to the child now or put it in a trust for the child - now. Have your husband execute the transfer documents and sign off on the transfer to the child or the trust. Do not leave this until after you are gone, as you never know what the laws are going to be in the future or what people will do once you are gone.
