Legal Question in Wills and Trusts in Australia

My brother is the executer of my fathers will (in Australia). Is there a statute of limitations preventing me from pursuing this legally if the funds don't ever arrive.

In some States of Australia, there is a limitation period of 12 years to administer a deceased Estate.

If your entitlement to the Estate depends upon some contractual or common law right (ie, a debt owed to you from the Estate) - then there is a 6 year limitation period.

From a practical point of view - documents & other evidence tends to disappear or be harder to get, the longer you wait.
