Legal Question in Personal Injury in Bahamas
Bahamas Injury
Dear Mr. Cevallos,
My wife and I were recently injured in a fall in the Bahamas.
Deck railing gave way and we have suffered serious back injuries. (for real)
It was a private home that we rented.
The owners live in the states and are U.S. Citizens.
The insurance company is in Nassau.
We signed all documents in the states.
We found the property through an online brokerage company that handles international rentals and they are located in the states.
The owners of this property own the brokerage company.
Do we have any possibilities of a claim?
Noticed your article in which you mentioned that it can be difficult to file a claim in the Bahamas.
Would appreciate any info.
Where are your offices located?
We live in FL.
Thanks,
Barbara & Floyd Palmer

Re: Bahamas Injury
We are a law firm in Florida. You definitely have a claim against the owners of the property, and perhaps the broker and others. It would be much easier for you to file a claim in the United States than in the Bahamas. We have worked on cases involving incidents in the Bahamas before. We would be happy to speak with you about the situation. We offer free initial consultation.

Re: Bahamas Injury
Our offices our located in Grand Bahama. It does sound as if you have a good claim in law. The best way to proceed would be to check with an Attorney in Florida. I cannot speak to Florida law but in my experience Florida courts would accept jurisdiction over your claim since there is a close connection to Florida. The connection would be even stronger if the owners of the property lived in Florida and the brokerage company was in Florida. If your Florida attorney advises that the Florida courts would not accept jurisdiction then you can file in The Bahamas but you may have to get permission from the Bahamas Court to serve the owners in the U.S. and this can be time consuming and expensive that is why I say it would be easier if the Florida Court accepts jurisdiction.
