Whether Legal and professional Fee is considered as costs that are recoverble against the Owners of the Vessel which was placed under arrest and whether the Plaintiffs have the right to claim these back from the party that was placed under arrest as a matter of bangladeshi Law? Furthermore whether it is the discretion of the Court to award costs or a separate suit has to be instituted for the recovery of the same?

Costs can be recovered and that can be done in the Admiralty suit, separate suit is not needed. It is standard practice to pray for costs in the plaint most of the time.But the courts usually do not allow recovery of the whole cost and will only allow a small portion. In practice, when the claim is totally frivolous , the court will costs to be paid to the other side.
