Negotiable Instruments Act 1881 Section 138
Landing bank has filed a civil suit for recovery of loan amount before Artho rin adalot and frozen the account but one of the unscropolous director inconnivarec with the lending bank official presented a undated cheque in the said frozen account. The bank issued two legal notice demanding payment against that cheque.Now the lending bank is threating to invoke section 138.
What will be my relief & how I can get rid of penalty under section 138.

Your lawyer must now keep a track of the case and inform you when a summons is issued. On the next date of appearance, your lawyer has to appear before the court and explain the state of affairs as described by you including presenting any relevant legal arguments such as whether the said director had the authority to issue the cheque.
