Legal Question in Family Law in Bangladesh
Dear Lawyer,
I am a British citizen in 2010 I went to go get married in Bangladesh.
I got married me and my wife were both happy I then stayed with her for 2 months before I came back to England. When I returned to England after a couple of months she asked me to go to Bangladesh again as she wanted to see me she said she was missing me. I then went back to Bangladesh and stayed with her for 4 months, in that time we found out she was pregnant of course she seemed happy and I was truly happy, I then realized that I only had a month left till I was due to come back to England. She asked me if I would return to Bangladesh at the time of her giving birth I said of course I will. I then returned to England and went back to Bangladesh after a couple of months. she then gave birth, after my son was born she started demanding that she wants to stay with her parents in Bangladesh and that I should look after her family meaning financially her parents and brother. I said I have to provide for myself you and my son I cant be providing for your family as I don't earn enough. She then stayed with her family and I returned to England. I left her with 1 lakh taka for her to feed clothe my son and maintain her expenses. A couple of months later I said to her you should go to do your esol test so that I can apply to bring you to England she said she wanted to stay in Bangladesh longer as her mum was ill. I said okay, after 3 months I asked her again it was the same excuse we then both started arguing I said stop making excuses when we got married you agreed that you would come to live with me in England she than switched her phone off, ever since then I do not know how my son is or where she is with my son in Bangladesh or where. My son is 1 yrs old what can I do to get custody of my son I know some people say I have to wait till he is seven years old to get custody but I mean in the mean time what can I do to stop her disappearing with my son.

in your question you did not say which religion you profess. however i am answering assuming you to be a muslim. you did not hear wrong. In bangladesh father has to wait till seven years to get custody of his male child. there are few others factors which may change the said time limit in either way. if your wife really avoids you, court will certainly interfere. you may go to criminal court and take order for searching your child with the assistance of police. at the same you may also go to family court to get the order of custody of your son in your favour. in bangladesh a mother can never prevent the father of her 1 year child from seeing, looking after and maintaining. You have a relief in bangladeshi law.
