Legal Question in DUI Law in California
Does a client, represented by an attorney on a DUI in San Diego, who has not waived his speedy trial rights, have to attend his Readiness/DWT hearing in Dept. 2, or can his attorney handle it with a 977 waiver?

If you authorize your attorney to handle the matter for you, that attorney has 977 authority and can attend your hearing without you being present.
Most private attorneys will do that for their clients. However, if you have a public defender, that PD may want you to be present because they cannot advise you of what is going on prior to that hearing.
Check with your attorney beforehand. Best of luck.
