Legal Question in Criminal Law in California
domestic violence-can charges be reduced?
my fiance was blacked out drunk when we started arguing. i said something that made him mad and he chased me through the house. i unsuccessfully tried to make it out the front door when he grabbed me from behind, threw me on the floor and kicked me in the back 3 times barefooted. i had no marks but a scratch on my arm. he immediately passed out. i called the police and he was arrested.
he is normally mild mannered and not a violent person. he is over 30 years old with no record whatsoever. he is now actively participating in AA and not drinking. this is an isolated incident. we have reconciled.
the judge offered 8 days of weekend work program, $200 fine and 52 weeks treatment program. i believe this is a very minimal sentence. he entered not guilty and is to return with an attorney next week.
if we were to pursue the matter and hire an attorney, is there any chance to have the charges reduced?

Without knowing what he was charged with and what he was offered no opinion can be given. However, based on your description of what he did the sentence seems to be reasonable. He should immediately contact an attorney regarding the scheduled trial. It is possible that the offer at the time of trial will not be as low as the plea bargain agreement. If he goes to trial and loses he will be at the mercy of the court and could be facing state prison.
