Legal Question in Family Law in California

A friend has been separated from his wife for nearly 40 years. This is not a legal separation nor a divorce. His wife is retiring and receiving CALPERS and he wants to know if he is entitled since they are still married.

yes, but he will have to apply for it with the court and CALPERS in order to get any. he might as will apply for a divorce if that is what he wants
