Legal Question in Technology Law in California
Harassment via Email
An individual I dated has broken into my computer at work and at home. He is sending me extremely nasty, scandalous and upsetting email messages. He has threatened to send individuals in my address book here and at home untrue, hateful letters with pictures. He has numerous email addresses that are web-based so we block them one at a time. This morning he sent me a copy of an email I sent a friend last night and later another very nasty email. Should I go to the police? What can I do to stop him?

You should go to the police. He may be in violation of various stalking, harrassment and extortion laws. One issue will be whether he can be identified as the one sending the emails. Many police departments will make a phone call on your behalf directing him to stop all contact or else they will refer the case to the district attorney.

In a word, yes. Save all the evidence you can. On a practical level, change your passwords. Run a virus and spyware check on your computer, in case he has a key logging / spy program installed on it -- if this is not something you are familiar with, hire a computer expert to assist. You may also want to consider the services of a private detective if the police and D.A.'s office are not helpful.
