Legal Question in Medical Malpractice in California
misdiagnosed, mistreated, now messed up
I'll keep this brief. I was hit head on I was a rear seat passenger with a lap belt on. Paramedics report states complaint of lower back pain so does the police report. Taken to hospital I remained there 6 days they never xrayed my lower back kept a catheter in I'm a diabetic type 1 while in hosp. they transferred me to ICU as I went into keytoacidosis after 1 good blood sugar reading they discharged me to a taxi & had my local fire dept. carry me in the house on a strecher board as I was unable to walk without morophine. 4 days later taken to another hosp.they xrayed my lower back found transverse process fracture L4& compression burst fracture L5 with retropulsed bony fragments from the posterior section of L5. I was treated poorly at the other hosp. also if contacted I can fax the medical reports or call and tell you the rest my injury was 6/99 I need to hire an attorney soon & file my doctor now says I'm crazy if I don't sue. I know it is a long expense process but this will be worth it.

You need to deal with one problem at a time. First, you should be receiving proper care that will enable you to heal. Second, you need someone to deal with the accident itself so that you can get some money to tide you over. Third, a case needs to be brought for the Malpractice at the same time as the accident is being dealt with so that time is not wasted and your rights are protected. I would be happy to take a look at your documents and inform you of your legal rights in this case. You should talk to a couple of lawyers, and not just lawyers in your area, and find one that you are comfortable with. Some clients are comfortable with small firms others like large. You have a very short time to file if in fact you do have a claim. An important thing to consider is if the delay in the discovery of the fracture caused any further injuries. Be happy to talk with you if you have further questions
