Legal Question in Family Law in California

Can my ex get a restraining order against me? Long story short, he called me, then refused to discuss business matters with me. I told him we could discuss it over the phone or I could go to him and we could talk about it in person (he was at work), when he brought up the restraining order issue.

Based on these facts, no he could not get a restraining order. To get a restraining order in family court based on the dating relationship, he's going to have to show either an attack or threats of attack or any actions which put him "in reasonable apprehension of an imminent attack."

I think it's best for you to keep all contact with your ex limited to written contact. No more calls or visits with him because he is obviously fishing for something with which to get you into trouble.
