Legal Question in Disability Law in California

Job Interviews

I was in the middle of a job interview when I was told the interview was over, because of my disability. The persons' office we were using, smoked and I can't be anywhere near smoke or someone who smokes. California is a NO smoking in public businesses state. So I thought this might be descrimination, is it? I got all the way through the testing and was going in for the semi-final interview when it was abruptly halted.

If the reason your job interview was terminated was because you indicated that you suffer from a disability that prevents you from being exposed to cigarette smoke in the workplace, the employer violated your rights under the California Fair Employment and Housing Act, as well as the California Occupational Health and Safety Act. You should see an employment law attorney in your area to discuss the facts of your case and determine what course of action to take.
