Legal Question in Disability Law in California

Mental Illness

I have been with my Employer for 15 + years, I have now been out on state disability for almost a year.

According to my Employee's handbook, my disability ''expires'' after a year. Do you know what that means...? I know that the funds for state disability runs out after a year...but since my company isnt paying me...what does that mean?

Very good question.

While the employer doesn't have to provide indefinite leave due to an employee's disability, the employer has an obligation to consider whether extended leave, beyond a typical one, can be a reasonable accommodation to an employee with a particular disability. The employer's obligation with regard to the length of allowed leaves depends on the size of the employer and other factors that determine the effect that your extended leave has on their business.
