Legal Question in Disability Law in California

my mother in laws boyfriend, who is a professional photographer, took photos of my 7 month old son in his studio with out my wifes and mine consent. He then posted the photos on his website for purchase. Also he sold some of them. Isn't this illegal in the state of california?
