Legal Question in Disability Law in California
Can paralegals assist with the name change process/documents. I reside in California.
1 Answer from Attorneys
The paralegal must be supervised by an attorney. A paralegal cannot provide legal advice; represent a client in court; select, explain, draft, or recommend the use of any legal document to or for any person except the attorney who directs and supervises the paralegal; engage in conduct that constitutes the unlawful practice of law; or contract with, or be employed by, a person other than the attorney to perform paralegal services. For further information, you can look up California Business & Professions Code section 6450.
You might also look up Business & Professions Code section 6400, which defines a "legal document assistant." That is a person who "may not provide any kind of advice, explanation, opinion, or recommendation to a consumer about possible legal rights, remedies, defenses, options, selection of forms, or strategies." That person may only complete "legal documents in a ministerial manner, selected by a person who is representing himself or herself in a legal matter, by typing or otherwise completing the documents at the person's specific direction."
