Legal Question in Disability Law in California

QME findings support my claim. Insurer is fighting this. What now?

The QME in my disability claim

supported my claim and found

permanent disability and 100%

cause arising from my workplace. The

insurer is ''quarreling'' with the

findings. What does this mean for my

continued care? Can they forestall

my care by contesting the QME

findings?

The insurance company may have decided to dispute the QME report by deposing the QME doctor and/or to request the doctor for a supplemental report. It depends on what they are diputing. They most likely are diputing the amount of disability that the QME gave you. They may be disputing the apportionment, they may be disputing the body parts he found, the qme may have recommended certain aspects of the treatment you need. As long as they are not disputing the treatment (i.e. surgery), you can still treat; at least to the extent that they are not disputing.
