Legal Question in Disability Law in California

Wrongful Termination of disability benefits

My husband was granted short term disability and was, we

believe going to be given his long term status but because of

incompotency in the drs. office was denied without any notice even

though his back condition worsened dramatically in the following

months. We have gone to court since and lost but my mothers

personal attorney represented us being only a Living Trust

attorney Ibelieve we still have a good chance to be reinstated. Also

the dr we had at the time in question fudged the papers from the

disability firm making it sound like my husband was faking it Also

concerning these papers they were never filed in time even after

repeated efforts on my part to see that they were

Re: Wrongful Termination of disability benefits

If your husband's case has gone to court and the case lost on its merits, you cannot file another claim on the same basis. If you believe the attorney was incompetent, you should consult with a malpractice attorney to determine if there are grounds for legal malpractice.
