Legal Question in Administrative Law in California
My father in law has a respectable reputation in our community, which is being ruined by his own brother. This man is spreading to the community that my father in law is swindling people out of their money since he is the president of our community association. This has caused anxiety, high blood pressure, and sleep apnea and this isn't healthy for a man that's 73 yrs old.
Can he sue for defamation of character?

Yes, as long as he can tell an attorney to whom and when it was said, and what exactly was said.
Yes, and in initial consultations with an attorney considering taking this case, be sure to have a full discussion as to whether the proposed lawsuit would be considered a "Strategic Lawsuit Against Public Participation" or "SLAPP" suit.....the laws in this area create a potential trap for the unwary, as the law can punish a plaintiff for filing a lawsuit that interferes with a person's right to speak up about issues where there is a significant public interest. Consider this subject carefully before filing!
