Legal Question in Appeals and Writs in California

abandon appeal

Does anyone know what it means to abandon an appeal?

I took my former employer to the labor board since he owes me over 10k, but the labor board only gave me 3500.I appealed, but when I went to court my former employer was a no show. When I asked the judge why he wasn't in court ,the judge stated he abandoned the appeal! What does that mean ? Does that mean he gave up and will pay whats owed or what? Its driving me crazy ,any help will be greatly appreciated!!

Re: abandon appeal

Your former employer can only abandon his own appeal, not yours. My sense is that both of you appealed from the original decision and that the employer abandoned his appeal before the hearing. This should have no bearing on your appeal. The employer should have shown up (perhaps via counsel) to argue his position, but probably was not required to do so.
