Legal Question in Appeals and Writs in California

appeal in criminal matter

I was deleted from a Drug Court Program and I am in the process of appealing the decision, The reason I was deleted is because the program said I forged a medical document. I had a 2 day no work, school, etc. excuse from the Dr. and I gave it to staff and they asked how long it was for and I told them I think two days, and then they told me that the paper had 12 days written on it, and accused me of forging the paper. Since I was deleted I will have to face the original Felony charge and be on probation for 3 years and sentenced to 150 days in custody. Since I am in the process of appeal, do I still have to turn myself in to do the 150 days.

Re: appeal in criminal matter

Yes. The fact that your case is on appeal has no effect on your sentence.

Contact the lawyer who defended you at trial and see if there is anything he can do to help you. You may have options, but they are not going to come from the Court of Appeal.
