I am not sure that I understand your question. A petition for writ of habeas corpus is not an appeal. However, a petition for writ of habeas corpus must be heard by the Superior Court in the first instance before it can be filed in the Court of Appeal, Third Appellate District. The only exception to that is where the Court of Appeal already has jurisdiction of your case as the result of a pending appeal in that court. You need to include more details before anyone can pose a direct answer. Good luck.
