Legal Question in Appeals and Writs in California

deadline for appeal

Hi,

What is the deadline for filing an appeal for an unlimited civil against a County agency? Is it the same as a regualar civil--60 days?

Georgia

Yes it is the same, but sometimes the time is less than 60 days.

The time is never less than 60 days. The general rule is 180 days from the judgment or order being appealed from, or 60 days from the date a party or the clerk serves notice. (Cal. Rules of Court, rule 8.104.)

You do not get an extension if the notice is served by mail. Be very careful to determine what is considered the notice, and whether it is appealable or not.

One Court of Appeal also offered this sage advice, which I take to heart, "don't wait until the last minute to file the notice of appeal if you are sure you are appealing."

This rule tends to help cover your behind if you make a mistake.

Very truly yours,
