Legal Question in Appeals and Writs in California

Hello,

I do not have a lawyer, I'm going to small claims court appeals - the defendants lawyer wants to settle, I told them I had a lawyer now they gave me a rule 4.2 they MUST communicate with them or get a letter in writing saying they will allow me to communicate with them. Suggestions on what to do? May court date is June 11, 2024

Thanks

If you want to discuss settlement with opposing counsel, you will have to tell them you don't have a lawyer. This is something they will find out anyway at the June 11 hearing unless you settle or hire an attorney before then. You don't have to admit that you lied; saying you don't have a lawyer now could mean that you used to have one but no longer do.

Parties are also allowed to contact one another directly, whether they're represented or not. (This assumes there is no other reason, such as a restraining order, why contact would be forbidden.) But the other party doesn't have to communicate with you and may refer you to their attorney instead.

Good luck.
