Legal Question in Appeals and Writs in California

mooning aka indecent exposure

My husband and I are devastated to learn our daughter's boyfriend was convicted of indecent exp after mooning after a night out. My daughter picked him up, and, funny guy that he was, he pressed his buttocks to the rear windshield as they drove away. First trial was a mistrial as the complainant never showed, but it was tried again. he was convicted of a mis after being convicted, NC, at age 19 for holding stolen earrings from a ''friend''. He is a great kid, no father, and someone we expect to have in our lives and family. We didn't hear about this as they thought it wouldn't amount to anything since my husband streaked at Dartmouth in the 70's showing much more body! He is subjected to horrid counseling with perverts. Is it too late to help??

I am sorry to hear about this tragic course of events. It sounds like a trumped-up case by an ambitious prosecutor. Your daughter's boyfriend has an absolute right to an appeal. Right now, the most important question is: when was he convicted/sentenced? There is a very short deadline for filing a Notice of Appeal, and he needs to act quickly. If he had legal counsel, his attorney should file (or should have filed) a Notice of Appeal to protect his rights.

There is no way to answer your question without knowing when he was convicted and sentenced. Determining when a notice of appeal must be filed can be tricky, so he should consult with qualified counsel ASAP. Feel free to contact me directly if you want to discuss this further; I am certified by the State Bar of California Board of Legal Specialization as a specialist in appellate practice.
