Legal Question in Appeals and Writs in California
My mother passed away in December of 2010 and my sister became the trustee of her properties. I have been unemployed and I was living with my mother in her townhouse. Now I live here by myself and my sister has been pressuring me to vacate this property so this property will be on the market.
As I'm one of the beneficiary, I have obtained a copy of the trust from her attorney and I understand all legal rights of the trustee.
However, since I have been unemployed (I have medical problems also)and living off the trust funds and other property assets(income) that my mother left. My sister threatened number of times that she would not give any expenses to me if I don't vacate this property. I had to cancel my dental appointment twice,I couldn't purchase one of my daily medication,I could not pick up groceries number of times because of that.
She has been complaining how much money I already spent and she would deduct all from my share of the property sale.
And seem that my eviction notice is on the way soon.
My questions are:
Does she have (trustee) legal rights to threat me(beneficiary)?
I personally feel that she has been threatening me.
I did go over the copy of the trust but did not state.
If it was my mother's will,(instruction) I had no choice.
Do I(beneficiary) have rights to know exact amount of the trust funds that my mother left and other property income(assets)that are coming on a monthly basis?
She never told me and she doesn't bother telling me.
