how long should a lawyer take to get a petition ready to be filed in to the courts. can we get a copy from lawyer of all payments given to him and contract because paper work was lost.

It depends on what kind of a petition is being prepared. If this is in superior court, there are statutes of limitation which are deadlines for filing. If in the appellate courts, there are also deadlines by rule, statute and case law.
Yes, you can get your entire original file, or a complete copy, from your lawyer, along with your billing records. Call him/her or send a letter if your relationship has deteriorated. Better yet, let your new lawyer contact the old one and find out exactly what is/or has happened.
