Legal Question in Appeals and Writs in California
retirement
I've been divorced for 5 years. I never fought for anything. I gave half of my house to my oldest daughter and he's suppose to sell the house and split it between our daughters. Can I go back to court and fight for some type of retirement from him. He works for the state and has a good retirement plan. We were married for 22 years at the time of the divorce. What is the cut off time for me to get anything from him when it comes to retirement?

Re: retirement
Did you have an attorney when you got divorced? If so this should have been dealt with in the marital settlement agreement. Start with what it says, as you may have waived any right to an interest in the retirement plan, although that is difficult to believe. Whether or not you had a lawyer then, go to see a family law lawyer now. And don't wait.
