my rights

Do police have the rights to take me to jail and charge me with drunk in public if I was not drunk and don't got any prove I was drunk

Usually when it's your word against the cops as to whether you were drunk, the judge is going to believe the cops. And just getting tossed in the drunk tank overnight won't get you criminally charged or result in a criminal record.
