Re: Rule of court

There are several different ways the record of what happened in the trial court can be assembled and presented to the Court of Appeal. The appellant must select one of these methods at an early stage, though in some circumstances the respondent can overrule his choice. A notice of designation is the form with which the appellant tells the appellate court how he is going to submit the record.

Rule 8.124 defines one of the available methods -- an appendix.

You can read the rule at www.courtinfo.ca.gov/rules/index.cfm?title=eight&linkid=rule8_124.

Appellate procedure is both complex and very different from trial court procedure. You should have an experienced appellate lawyer if at all possible. I am certified by the State Bar as an appellate specialist. Please feel free to contact me directly.
