Legal Question in Banking Law in California
According to California civil code section 1719 the plaintiff may collect anywhere between $100.00 and $1500.00 in addition to the amount of the bad check, as long as the defendant is notified by certified mail 30 days prior. So what are the factors the judge considers when determining the amount to award the plaintiff? Are punitive damages taken into consideration?
