Legal Question in Banking Law in California
Civil suite
A collections company is threatening to sue my wife for a debt over 12 years ago in California. Is this possible and don't they have to ''serve'' her with some sort of documentation?

Re: Civil suite
The statute of limitations to sue on an old debt (in most cases, depending upon the type of debt) has long passed in California. Threatening to take legal action when they are not entitled to is an actionable offense under the FDCPA, which may enable you to recover $1000 per violation.
I would be willing to discuss some of the issues concerning your experience to see if there may be legal justification to pursue your case.

I look forward to speaking with you.
