if a gym uses my card to make a purchase and no purchase was authorized by me and i filed a claim through my bank and the gym and both denied who do i take to a small claims court?

Are you talking about your gym card or a credit card on file? If a credit card on file used by an employee, then you sue the gym and the employee (if known). You might also file a claim with the local police department just to get the identity theft on file, and also notify the three credit reporting agencies that you dispute the amount that might appear on your credit card because of identity theft.
