Legal Question in Banking Law in California

Internet Gambling

This might be a dumb question but if my bank processes transactions for the sole purpose of internet gambling which is agaist the law that was passed a while back(UIGEA) unlawful internet gambling act, can I sue my bank to retrieve these funds even if I was the one to initiate these transactions? I thoughtt my bank should be the one to protect from these transactions because of this law( I confess that I am a compulsive gambler but my bank should bar these transactions, I think. What can you tell me. It doesn't hurt to ask. Any cases like this that you know of? Pleasee let me know. Thanks.

As I understand UIGEA, 1) it doesn't take effect as against banks until the Treasury Dept comes out with regulations interpreting the act, and 2) it might not provide a private right of action for folks such as yourself. If the regs were already published at the time the transfer was made, maybe the courts would bail you out, who knows.
