Legal Question in Banking Law in California
I recently attempted to do a refi on my mortgage. The refi company informed me that the loan has no FHA mortgage insurance. This is confirmed by FHA. The current holder of the loan, Bank of America, lists "FHA MIP" on all my statements, and has collected the insurance premium every month. I told them I will no longer pay for nonexistent insurance, but they insist I should still pay. I also want to look into recovering previous insurance payments.

Have you confirmed that it has no mortgage insurance on it at all? Just because the statement's coding is wrong or misleading doesn't end the inquiry as to whether the charges are proper.
