Legal Question in Banking Law in California
If you are a salesman and work on commission and then get arrested and sit in jail awaiting a trial, are you still elgible to receive your commission checks just as you did before you were arrested?

You are presumed innocent while awaiting trial and you retain all of your civil rights, including the right to receive money that you have earned. You would still have the right to receive earned funds post-conviction.

I agree with Mr. Stone, unless you have a contract that says you are only paid commissions on customer payments recieved while you are an active employee, but not after termination or when you are not working.
