Legal Question in Banking Law in California
I placed a stop payment on a check to my subcontractor because he did not show up after the payment. After the whole work was done, I wrote another check to him and paid everything in full. However, I did not know he deposited my first check through check cashing company. Now the Check casing Co. ask me to pay the first check I stopped. And they said they might need to go to court against me. What should i do?

Tell them their problem is with the contractor not you. Tell them to go to court against him. He was the one who failed to show up so you stopped payment on check, he then obviously lied to you about the first check to get you to cut him a second check. Tell the check place to go chase him, you had legitimate reason to stop payment and you already paid him for work
By the way I hope you checked to make sure he had insurance.
Hope that helps and good luck.
