Legal Question in Bankruptcy in California

In May 2012, my partner and I signed a Domestic Dissolution Settlement where she agreed to pay me. I agreed to small payments. Suddenly she filed Chapter 13 Bankruptcy in January 2013, sighting me as one of the creditors. I need to know what documents to file to fight this. She agreed to our settlement and then put stops on the payments. I was told that she was required by law to pay this and now she is filing this. Please let me know.

Mr. Andersen is correct. We would need to review the DDS first before assessing whether it is excluded from the Bankruptcy stay.

I agree that not enough information has been provided. You should see a local attorney with experience enforcing creditor's rights in bankruptcy to review the document to see if you have any legal remedies available to you.
