Legal Question in Bankruptcy in California

Alternatives to filing bankruptcy

I am considering filing bankruptcy. My friend told me there is a 1983 federal law which should be my first step before filing. This law allows me to deal with my creditors to reduce my debt because I am a wage earner. Is this true?? Can you provide more details? If not is there an alternative to bankruptcy???? Thanks Dan

Re: Alternatives to filing bankruptcy

Thanks for your posting. You, or maybe your friend, might be a little confused.

There is an act under section 1983 of the U.S. Code that is known as the "Fair Debt Collection Practices Act", although it was not passed in 1983. That act limits what collection agencies or debt collectors can do in contacting you to collect a debt.

You might also be thinking of a chapter 13 bankruptcy -- as a wage earner, you can use future income to pay off a portion of your debts.

You can also arrange for a debt consolidation with a finance company, or arrange it through the consumer credit counseling service (CCCS) in your area.

If you have other questions, please feel free to email me back. Best of luck.
