Legal Question in Bankruptcy in California

What assets can I keep in a Chapter 13 Bankruptcy

My husband is very apprehensive about filing a Chapter 13 bankruptcy. We have about $5,000.00 worth of stock, about $50,000.00 collectively in our 401K and Annuity plans. My husband thinks if we file for a Chapter 13, the court will sell our stock and possibly take our retirement funds to pay for our debts. Is this true?

No, that is not true. There are extensive nuances and pitfalls to Ch. 13 though, so you should definitely consult with a professional in your area.
