Legal Question in Bankruptcy in California

My Attorney Filed Bankruptcy

My attorney filed bankruptcy (I don't know when). I still owed him approximatey $2250 at the time for a custody case he handled on my behalf and have not paid him anything since May 2005. Now, a credit/collection agency that says it is working on behalf of the bankruptcy trustee is trying to collect the debt and has threatened a judgement against me. I am trying to work with the collection agency to settle the debt (have not yet made a payment), but they are not accepting my offers. What are my obligations/risks?

Re: My Attorney Filed Bankruptcy

Assuming your case was a no-asset Chapter 7, the debt has been discharged (whether it was specifically listed or not). Send the agency a copy of your Discharge Letter from the Court and instruct them to never contact you again on the matter.
