Legal Question in Bankruptcy in California

Attorney wont help.........

Good morning, i filed chapt 7 in december 03 and had my 341 meeting in febuary 04. In january one of the LISTED creditors ( pay day loan) went in to my checking account and debit $300.00 plus a $50.00 nsf fee! which made me overdrawn and late on my morgage company. i told my attorney and he said its alot of work to get that money back and it might not be worth HIS effort!( he did say if i write down all that has happen he will write a LETTER on my behalf for $100.00 !!!!) What ever happen to the ''automatic stay'' When i was late on morgage, due to above, my attorney called me and said that '' the Morgage co said that they will file a removal of auto stay and start to foreclose if they didnt get the morgage pymt( i did get the bill paid and all is well) I want the ''pay day loan'' to returned the $350.00 can i do this myself? if so, How? and will it be effective? this has been hard on us, and BK is to relif us and to have a fresh start! Can i take the company to court, how do i explain ''how i want my money back from a check i wrote to them for cash'' thanks so much.

Call pay day and tell them to reurn the money or you will notify the judge. Also tell your attorney that he has to represent you in this matter.
