Legal Question in Bankruptcy in California
Baknruptcy - Disnmissal vs. Discharging
We filed for bankruptcy on Aug 26, 1992 & we had it dismissed by the courts on Dec 13, 1995. This was suggested by our attorney at the time as we were able to pay our creditors without going through the trustee. The bankruptcy is still showing on our credit reports even though our attorney said a dismissal would be like it never happened. Do the credit reporting companies have the legal right to show the bankruptcy even though the courts have dismissed it? And if they do, how long will it stay on our reports?

I'm not completely sure of the answer, but I believe they can still report the bankruptcy for up to 10 years from the date it was filed. They should also have listed that it was dismissed.
