Legal Question in Bankruptcy in California

Bankruptcy advantage

I am supporting a disabled mother of 2 children who is fighting to keep her welfare benefits. She has an unsecured debt in credit cards of approx 25,000. She constantly gets credit card statements that she pays on that are higher each billing cycle. She fears backruptcy as she does want to lose her car that is sn her mothers name on the contract. The debts need to be neutralized so that she can provide for basic living needs + care for her 2 children. She is 41 a recovering alcoholic whose educational status is less than highschool. She cannot comprehend easily and is educationally retarted. Is there anything you can recommend.

Well, I would recommend bankruptcy. Why does she think she'll lose the car? Perhaps you can have a guardian appointed and file bankruptcy that way. If she can't comprehend the ramifications of bankruptcy, it will be difficult getting an attorney to represent her. You can also try negotiating repayment with the creditors. A lot depends on what assets she has subject to execution. A consultation is definitely in order.
