Legal Question in Bankruptcy in California

Bankruptcy affecting future student loans

I am currently thinking about filing bankruptcy. However, I want to go back to school and don't want to include my current student loan in this process. My payments are on time. Do I have to include them

I'm not sure what you mean by "include". Under any chapter of bankruptcy you must LIST all your assets and all your debts. Student loans are presumptively nondischargeable. Moreover, regardless of whether or not you were discharged from the debt, it would not affect your future ability to obtain student loans, as such lenders are strictly prohibited from discriminating or denying loans on the basis of bankruptcy.
