Legal Question in Bankruptcy in California
In this bankruptcy case, the creditor's counsel failed to proceed with the adversary proceeding, and the adversary proceeding was dismissed without prejudice, and the bankruptcy was discharged. New counsel was obtained and a motion to vacate the dismissal was granted; however, the bankruptcy court asked for further briefing as to whether it had the authority to revoke the discharge. Has there been similar case where the bankruptcy court revoked the discharged and was affirmed on appeal?
