Legal Question in Bankruptcy in California

Bankruptcy

Common law husband and I were getting a divorce in Texas and was going to court to get spousal support. He goes to California and files for bankruptcy. Is there any recourse?

If he had not lived in CA for the greater part of the past 180 days before he filed, the case likely will be thrown out (dismissed). You might write to the appointed Chapter 7 trustee if that's the case, and send evidence that he maintained his residence in TX. He's a shrewd one because CA does not recognize common law marriage in CA although I can't say whether it would recognize it if TX does! It might help to find a knowledgeable family law practitioner in the CA locale who also practices bankruptcy for a consultation about your options.
