Legal Question in Bankruptcy in California

Bankruptcy Discharge Notice

I file bankruptcy in january 1992, which mean as far as I know that it should of been discharged in January 2002 (10 years). I have not received any notices of the disccharge. I have kept my change of address current and have not heard from anyone concerning this matter. What should I do?

Your discharge was 6 to 8 months after you filed. Six years after you filed you can refile another Ch. 7. Ten years after you filed the bankruptcy is supposed to be taken off your credit report. Anon.

You filed bankruptcy in Jan. 1992 and haven't received your discharge yet? What chapter did you file under? Only Ch. 11 could possibly be still open after 10 years, although that is hugely unlikely. If you filed a ch. 7, you would have received your discharge sometime in May of 1992 unless there were problems (of which you would have been aware). I would contact your attorney immediately or, if that doesn't work, order a copy of your court file and have a new attorney look at it to figure out what is going on. I would be happy to do so.
